Laken Riley Act signed into law – Immigration Impact

President Donald Trump on January 29, 2024 sign the Laken Riley Act into law requires mandatory federal detention of undocumented individuals who are accused of the following activities which constitute the essential elements of the following criminal acts:

  • Theft
  • Burglary
  • Shoplifting
  • Assaulting a law enforcement officer, and
  • Any crime that causes death or serious bodily injury.

The categories of individuals who are subject to these provisions include:

  • Individuals who entered the country without inspection
  • Individuals who by fraud or willfully misrepresenting a material fact, seek to procure (or have sought to procure or have procured) a visa, other documentation, or admission into the United States
  • Individuals who are not in possession of a valid unexpired immigrant visa, reentry permit, border crossing identification card, or other valid entry document

No Immigration Judge will have the right to release any individual detailed with the exception of whether someone is properly included in the above-referenced categories.
