Custody of Child Changed after repeated Benadryl Dosings

Custody of a 6 year old Ulster County child was awarded to the father after the Court found that the repeated administering of Benadryl to "help him fall asleep" 3 or 4 times a week.  The parties previously had joint custody of the child but when the father noticed the child in a zombie-like state he filed a neglect proceeding against the mother.

Divorce & Double Dipping is Alive and Well

In a recent divorce decision from the NY 2nd Department in Palydowycz v. Palydowycz (NYLJ, April 14) , the Court has ruled that a husband's medical practice's income can serve as BOTH a basis for establishing maintenance to the wife as well as a basis for establishing a value for the practice itself.
